1. Status of this Policy
1.1 This Policy forms part of, and is incorporated into, the Terms and Conditions, and should be read together with the Intellectual Property Policy and the Community Guidelines.
1.2 This Policy sets out the procedure by which a rights holder may notify Craftolin of content published on the Platform that infringes their copyright or other intellectual property right, and how Craftolin responds.
2. Craftolin's Position
2.1 Craftolin respects the intellectual property rights of others and requires Users to do likewise.
2.2 Publishing a product image, description, or other content that infringes the copyright of another person is prohibited under the Community Guidelines and the Intellectual Property Policy.
2.3 Craftolin is an intermediary and does not create, select, or review the content published by Users before publication. It acts upon notice in accordance with this Policy and with rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
3. Submitting a Notice of Infringement
3.1 A notice of infringement should be sent in writing to support@craftolin.com and should contain:
(a) your name, postal address, email address, and telephone number;
(b) identification of the work in which copyright or other right is claimed, with sufficient particulars to identify it;
(c) evidence of your ownership of, or authority in respect of, that work;
(d) identification of the allegedly infringing content, being the Listing, image, profile, or review complained of, with sufficient particulars, including any reference code or link displayed in the Platform, to enable Craftolin to locate it;
(e) a statement that you have a good-faith belief that the use complained of is not authorised by the rights holder, its agent, or Applicable Law;
(f) a statement that the information contained in the notice is accurate, and that you are the rights holder or are authorised to act on the rights holder's behalf; and
(g) your physical or electronic signature.
3.2 Craftolin may request further information or clarification before acting upon a notice, and may decline to act upon a notice that does not contain the particulars required by clause 3.1.
3.3 A person who knowingly submits a false or misleading notice may incur liability under Applicable Law, and may have their own access to the Platform restricted.
4. Craftolin's Response
4.1 Craftolin will acknowledge receipt of a notice within twenty-four hours of its receipt.
4.2 On receipt of a notice that appears valid, Craftolin may remove or disable access to the content complained of, and will notify the User who published it, providing the substance of the notice.
4.3 Craftolin will dispose of the complaint within fifteen days of its receipt, and will inform the complainant of the action taken.
4.4 Content that is the subject of an order of a court or a notification of a government agency will be removed within the period prescribed by rule 3(2)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
4.5 Craftolin maintains a record of each notice received, the action taken, and the date of that action.
5. Counter-Notice
5.1 A User whose content has been removed or disabled, and who believes that the removal resulted from a mistake or a misidentification, may submit a counter-notice to support@craftolin.com containing:
(a) identification of the content that has been removed or disabled, and the location at which it appeared;
(b) their name, postal address, email address, and telephone number;
(c) a statement made in good faith explaining the basis on which restoration is sought, including particulars of the rights or licence relied upon; and
(d) their physical or electronic signature.
5.2 Craftolin will consider a counter-notice and may restore the content where it appears appropriate to do so. Craftolin may notify the original complainant that a counter-notice has been received.
5.3 Craftolin is not obliged to adjudicate a dispute as to the ownership of any right. Where a dispute is not resolved between the parties, Craftolin may maintain the removal pending the determination of a competent court or authority.
6. Repeat Infringers
6.1 Craftolin maintains a record of Users against whom repeated and substantiated notices have been received, as contemplated by the Consumer Protection (E-Commerce) Rules, 2020.
6.2 Craftolin may restrict, suspend, or terminate the account of a User who repeatedly infringes intellectual property rights, and may decline future registration by that User.
7. Trademarks
7.1 A complaint concerning the misuse of a trademark, brand name, or logo may be submitted to support@craftolin.com, following the procedure in clause 3 so far as it is applicable.
7.2 Trademarks displayed on the Platform belong to their respective owners.
